  1. ACCEPTANCE OF TERMS

These Terms and Conditions (“Terms”) govern access to and use of The Physics Gateway Android application, thephysics.co.in website and the educational services supplied through them (collectively, the “Services”). The Services are operated by Viswanath Educational Services (“we”, “us”, or “our”).

By creating an account, accessing content, purchasing a product, participating in an examination or otherwise using the Services, the user agrees to these Terms, the Privacy Policy and the Refund and Cancellation Policy. A person who does not agree must not use the Services.

  1. ELIGIBILITY

The Services are intended primarily for higher-education learners and competitive-examination candidates. A person who is not legally capable of entering into this agreement must use the Services only with the consent and supervision of a parent or lawful guardian. The parent or guardian is responsible for the minor’s use of the Services and payments made for the minor.

  1. ACCOUNTS

Users must provide accurate and current information and must keep login credentials confidential. Each learner account is personal to the registered user and may not be sold, transferred, rented, shared or made available to another person.

We may use reasonable technical and administrative controls to detect simultaneous use, credential sharing, abnormal device changes, unauthorized access, piracy, automation or other abuse. These controls may include session limits, device or app-instance records, verification requests and temporary access restrictions.

A user must promptly notify us if an account or device is suspected to be compromised. We may require reasonable verification before restoring or changing access.

  1. LICENSE TO USE EDUCATIONAL CONTENT

Subject to these Terms and any applicable payment, we grant the registered user a limited, personal, revocable, non-exclusive, non-transferable right to access the purchased or free content during the stated access period for private educational use.

No ownership or intellectual-property right is transferred. Unless we expressly authorize it in writing, users must not:

  • download content where downloading is not offered;
  • reproduce, copy, photograph, screen-record, redistribute, publish, sell or commercially exploit content;
  • share PDFs, HTML lessons, videos, formula cards, recall cards, questions, explanations, test papers or credentials;
  • remove or conceal watermarks, Student IDs, copyright notices or security controls;
  • bypass paywalls, access rules, screenshot restrictions, authentication or technical protections;
  • scrape, crawl, bulk-extract, reverse engineer or use automated systems to copy the Services; or
  • use our content to train, populate or operate another commercial course, question bank, application or artificial-intelligence system without written permission.
  1. COURSE ACCESS AND FEATURES

Course structure, release schedules, free samples, paid items, lesson order, live-class availability, examination schedules and access periods may differ between products. Users receive only the content and entitlements stated for the selected product.

We may add, correct, reorganize or update content to improve accuracy or delivery, provided that the essential nature of a paid product is not materially reduced without an appropriate remedy.

Some features may be hidden, unpublished, experimental or released later. Their presence in administration tools, promotional previews or source code does not create an entitlement until they are officially made available to the user’s account.

  1. PRACTICE QUESTIONS, QUIZZES AND SCHEDULED EXAMINATIONS

The Services may include:

  • topic-wise practice with immediate answers or explanations;
  • course quizzes linked to lessons;
  • scheduled weekly, monthly, grand or topic-specific examinations;
  • delayed release of answers and explanations;
  • ranks, leaderboards and performance analytics.

Examination rules, opening and closing times, marks, negative marking, permitted attempts, result-release time and ranking method displayed for a particular examination form part of these Terms.

Users are responsible for maintaining a suitable device, power supply and internet connection. We may investigate technical failures and correct demonstrable system errors, but we do not guarantee an additional attempt for failures caused by the user’s device, connectivity or failure to submit before the closing time.

Ranks may change if invalid attempts, duplicate accounts, cheating, technical corrections or scoring errors are identified. Our reasonable post-verification result will be final for the educational platform, without affecting any non-excludable legal right.

  1. LEADERBOARDS AND USERNAMES

Scheduled-examination leaderboards may display rank, username and marks. Users must choose a lawful and appropriate username and must not impersonate another person, disclose another person’s private information, or use abusive, discriminatory, obscene or misleading wording.

We may edit, hide or replace an inappropriate username and may exclude fraudulent or invalid attempts from rankings.

  1. USER-SUBMITTED MATERIAL

Users may submit doubts, messages, feedback, photos, screenshots, files or documents where a feature permits it. A user retains ownership of original material but grants us a limited permission to store, reproduce and process it only as reasonably needed to provide support, operate the relevant feature, maintain records, secure the Services and comply with law.

Users must not submit unlawful, infringing, malicious, abusive, confidential third-party or personally sensitive material that is not necessary for the educational request. We may remove content or restrict an account where misuse occurs.

  1. LIVE CLASSES AND THIRD-PARTY LINKS

Live classes may be scheduled, changed, rescheduled or marked completed. Links may open a third-party streaming, video or communication platform. Availability and conduct on that platform may also be subject to the third party’s terms.

Recordings are available only when expressly stated. A live session that is not advertised as recorded does not create a right to a recording.

  1. FEES, TAXES AND PAYMENT

Prices, access duration, included features and applicable taxes will be displayed before purchase. Payment must be made only through an official payment method displayed in the App, Website, Google Play purchase flow or verified communication from us.

Payment for digital content distributed through Google Play will use Google Play Billing or another billing option only where permitted and properly implemented under Google Play’s applicable programme and local requirements. No external payment method is available merely because its technical structure exists; it becomes available only after official activation.

Users must not send a UPI PIN, OTP, full card credentials or banking password to us. Refunds and cancellations are governed by the Refund and Cancellation Policy.

  1. ACCEPTABLE USE

Users must not:

  • cheat, collude, use multiple accounts or manipulate an examination or leaderboard;
  • interfere with the operation, security or availability of the Services;
  • introduce malware or attempt unauthorized access;
  • harass administrators, instructors or other users;
  • submit false payment, identity, deletion or refund claims;
  • use the Services for an unlawful purpose; or
  • help another person perform a prohibited act.
  1. SUSPENSION AND TERMINATION

We may temporarily restrict, suspend or terminate access when reasonably necessary to investigate or respond to credential sharing, fraud, piracy, payment reversal, security risk, unlawful conduct or a material breach of these Terms. Where appropriate, we may ask the user for verification or provide an opportunity to explain.

Termination for a material user breach does not automatically create a refund. This does not limit remedies or consumer rights that cannot lawfully be excluded.

  1. ACCOUNT DELETION

Users may request account deletion through the App or the public instructions at:

Deletion consequences and limited lawful retention are described in the Privacy Policy. Deleting an account may permanently remove access, history, saved progress, results and other account-linked data. Account deletion is distinct from cancelling a payment mandate or requesting a refund.

  1. INTELLECTUAL PROPERTY

The Services, branding, software, interface, educational presentation, original lessons, formula cards, recall cards, question banks, explanations, graphics and compilations are owned by or licensed to Viswanath Educational Services and are protected by applicable intellectual-property laws.

Third-party examination names, institutions, trademarks and past questions remain the property of their respective owners. References to examinations such as GATE, NET, JEST, JAM, SET or BARC identify the examination context and do not imply endorsement, affiliation or sponsorship unless expressly stated.

  1. EDUCATIONAL DISCLAIMER

The Services provide independent educational preparation. We are not an official examination authority and do not guarantee admission, qualification, rank, employment, marks or any particular result.

We take reasonable care in preparing content, but errors, changes in syllabi, official answer-key revisions and differences of academic interpretation may occur. Users should consult official notifications and source materials for binding examination information and should report suspected errors for review.

  1. AVAILABILITY AND MAINTENANCE

We aim to provide reliable access but do not promise uninterrupted or error-free operation. Maintenance, internet failures, cloud-provider incidents, force majeure, security events, legal requirements or platform changes may temporarily affect availability.

We will use reasonable efforts to restore material service failures. Temporary interruption does not automatically create a refund unless the Refund and Cancellation Policy or applicable law provides otherwise.

  1. LIMITATION OF LIABILITY

To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential loss arising from examination outcomes, user-device failures, third-party platforms, unauthorized credential sharing or use contrary to these Terms.

Where liability cannot lawfully be excluded, our liability will be limited only to the extent permitted by applicable law. Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded or limited.

  1. CHANGES TO SERVICES OR TERMS

We may update these Terms to reflect changes in the Services, law, technology or business operations. The revised version will show an updated date. If a material change affects existing paid access, we will provide reasonable notice through the App, Website, email or another appropriate channel.

  1. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of India. Subject to mandatory consumer jurisdiction and other non-excludable rights, disputes will be subject to the competent courts and forums having jurisdiction in Hyderabad, Telangana.

Before initiating formal proceedings, users are encouraged to contact the grievance officer so that the matter can be reviewed and, where possible, resolved.
